Family Court Matter Decided in Favour of Husband After Maintenance Claim Was Rejected
Case Overview
The marriage between Sunita and Menak was solemnized according to Hindu rites and customs. After marriage, both parties resided together at the matrimonial home, and their married life remained peaceful for some time.
However, due to matrimonial disputes and differences in temperament, disagreements arose between them. Thereafter, Sunita left the matrimonial home and started residing at her parental house.
Subsequently, Sunita filed a maintenance application before the Family Court, alleging that Menak had neglected and refused to maintain her. She prayed for monthly maintenance, claiming that she had no sufficient income to maintain herself.

Menak appeared before the Court and filed his written statement denying all allegations. He contended that he had never neglected or refused to maintain Sunita and was always willing to keep her with him.
He further submitted that Sunita had voluntarily left the matrimonial home without any reasonable or sufficient cause. Menak also argued that Sunita was educated and capable of earning, and therefore was not entitled to claim maintenance as sought.
